Terms and conditions

Written in plain language, not legalese. They say what we do and what we do not do.

Version of 26.09.2026 (billing at real cost). By creating your account, you accept this version; when it changes, we tell you (article 13).

1. Who

The Emodio service is provided by Victoria Gaillard Sàrl, Avenue des Alpes 90, 1820 Montreux, IDE CHE-103.457.224. “We” means this company. “You” means the person or business that opens an account.

The service is reserved for customers established in Switzerland: businesses with their registered office or a branch there, and individuals domiciled there. We do not sell subscriptions or top-ups to customers established elsewhere, in particular in the European Union.

2. What the service does

Emodio makes vertical motion design videos from what you write, and cuts the long videos you import into short clips. A language model writes the script and the code of each video; a synthetic voice speaks the text; a rendering engine produces an MP4 file that you download and use as you wish.

3. What you produce belongs to you

The videos you make are yours, including for commercial use, with no limit in time or territory, and this remains true after your subscription ends. We claim no rights over them and we do not reuse them, neither for demonstrations nor to train anything, unless you explicitly authorise us to in writing.

In return, you guarantee that what you upload (photos, logos, music) is yours or that you have the right to use it. The media library asks you to state the rights for each file, and a media item marked “to be checked” never goes into a video.

4. What you may not do

• Produce content that is illegal, defamatory, hateful, or that impersonates someone.
• Produce intimate images or videos of a person without their consent, or any sexual content involving a minor.
• Clone the voice of anyone other than yourself without their express consent, given by that person themselves; clone the voice of a public figure or of a minor.
• Use the videos to deceive: pass off a fabricated person, voice or event as real without saying that it was generated by AI (article 9).
• Import videos, music or images you do not hold the rights to (article 8).
• Publish misleading financial advice. The product is designed to educate about Swiss real estate: the domain rules already forbid promises of returns and advice without figures, but responsibility for what you publish remains yours.
• Resell access to the service under another brand, or use it to build a competing service, without our written consent.
• Circumvent the balance, the rate limits or the security measures.

If you do not comply with this article, we may remove the content concerned and, in serious or repeated cases, close your account; you keep the right to retrieve your videos and your data.

5. Agent accounts

You may have videos ordered by software (API, MCP, agent) with a key created in your account. Everything ordered with your key is done in your name: you remain responsible for it, for the budget, the use and the content, as if you had ordered it yourself, and it is debited from your balance. Keep your key secret. You can revoke it at any time; if you think it has leaked, revoke it immediately: what was ordered before revocation remains due. We may limit the rate, and suspend a key that endangers the service, after telling you.

6. The subscription, the balance and prices

There is no free trial: to make videos, you need an active paid monthly subscription. Your account has a balance in Swiss francs. Each month, your subscription credits your balance with the amount you paid:

The price of a video depends on what it takes to make; it is debited from your balance as you go. Each production is debited at its real production cost (voice, writing by the model, transcription, images, rendering, conversation with the studio), multiplied by a service coefficient that we set. You can see the detail of every debit at any time on the Account page, in the balance tab.

• Your balance is counted in credits: 1 credit = 1 Swiss centime (CHF 20 = 2000 credits, plus your plan’s bonus). You can top it up whenever you like; the top-up amount is added to your balance.
• Before a significant job (for example cutting a long video), we make an estimate. If your balance does not cover it, the job does not start. The amount actually debited may differ from the estimate.
• A balance at zero or below blocks all production until your next top-up. A negative balance (a job that cost more than expected) is owed: it is deducted from your next top-up or your next subscription payment.
• Your balance does not expire. Without an active subscription, you can keep using it, but the videos made in the meantime carry a “Made with Emodio” banner (our mark and the address emodio.ch), added by us and visible throughout the video. As soon as you subscribe again, new videos come out without the banner; those already made keep it.
• When you close your account, the part of your balance that comes from top-ups and that you have not used is refunded on written request to bonjour@emodio.ch, within 30 days. The part that comes from the subscription is not refunded.
• Without a subscription, you keep everything you have made: your videos remain accessible, playable, downloadable and exportable, with no time limit. You can still make videos with your balance, with the Emodio banner; with a zero balance, production is closed.

Prices are in Swiss francs, and they are what you pay: no VAT, as we are not registered for Swiss VAT at this stage.

Founder price. If you are among the first people on the waiting list and we offered you the founder price, your subscription price is guaranteed for 12 months from your first payment, as long as your subscription is not interrupted. If you cancel and come back later, the current price applies. At the end of the 12 months, we announce the new price at least one month in advance, and you can cancel free of charge before it applies.

We may change our prices, the subscription price as well as the service coefficient, but never during a paid period, and never without telling you one month in advance; you can then cancel before the increase applies.

7. Paying, changing, stopping

• Payment is monthly, in advance, by card, via Stripe. The subscription renews tacitly every month until you cancel it; we remind you before each payment.
• You change plans whenever you like. The difference is calculated pro rata, both ways.
• You cancel whenever you like, in one click, from the Account page. Cancellation takes effect at the end of the period already paid: the service continues until then, we do not cut off a month you have paid for, and we do not refund a period that has started either.
• If a payment fails, Stripe retries automatically and we let you know. You can keep making videos normally for 5 days; after that, and until payment, your new videos carry the Emodio banner (or production stops if your balance is empty). Nothing is deleted: your videos remain accessible, and everything returns to normal as soon as the payment goes through.
• The mobile app sells nothing: the subscription is taken out and managed on the website.

8. The videos and media you import

When you import a long video to be cut, music or an image, you guarantee that you hold the rights or the necessary permissions: to the images, to the voice and image of the people filmed, and to the music. If someone makes a claim against us because of a file you imported, you indemnify us and bear the reasonable costs of our defence.

We do not check your files in advance. If manifestly unlawful content is reported to us, we may suspend it, telling you and explaining why; you can contest by writing to us at bonjour@emodio.ch. Do not import videos from a platform (YouTube, TikTok…) that are not yours: their terms forbid it, and so does copyright.

9. AI in your videos

The videos are generated or edited with AI: a language model writes the script and the code, a synthetic voice speaks, images may be generated, and clips are selected and subtitled automatically.

You do not use them to deceive. If you publish a generated video that realistically shows a real person, their voice or a real event, you label it as AI-generated: this is what the European AI regulation (art. 50) requires as soon as the video is seen in the European Union, and it is honest towards your audience anyway.

A cloned voice requires the consent of the person whose voice it is, given by that person themselves by recording the consent sentence; we keep the proof. The voice serves only your organisation. The person can withdraw consent at any time: the voice is then deleted, by us and by our provider.

10. What we guarantee, and what we do not

We undertake to run the service conscientiously, to let you know when something is wrong, and to publish our service status in real time on the status page. No video is delivered without having passed our automatic checks for legibility, contrast and duration.

We do not guarantee one hundred per cent availability, nor that you will like every video. We depend on third-party providers (model, voice, hosting): when one of them is unavailable, the corresponding feature switches to degraded mode and says so clearly.

11. Liability

Our liability is limited to the amount you have paid us over the last twelve months, except in the case of gross negligence or wilful misconduct on our part. We are not liable for indirect damage: loss of profit, damage to reputation, loss of customers. Nothing in these terms limits a liability that Swiss law makes mandatory; if you are a consumer, these limits apply only to the extent the law allows.

12. Your data

How we process it is described in the privacy policy. If you use Emodio to process the data of your own customers, the data processing agreement applies automatically.

13. Changes

We may change these terms. A change to your disadvantage is announced 30 days in advance by email, and you can cancel free of charge in the meantime.

The service evolves too. We may change it for a valid reason (security, law, change of provider, improvement), without charging you more. If a change puts you at more than a minor disadvantage, we tell you at least 30 days in advance, and you can cancel free of charge; the part of your balance that comes from top-ups and that you have not used is then refunded.

14. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is Montreux (canton of Vaud). If you are a consumer, you may also bring proceedings before the court of your domicile in Switzerland, as the law guarantees (art. 32 of the Swiss Civil Procedure Code).
